In March of 2018, the firm successfully obtained summary judgment in federal court for a police officer who was working off-duty as a security guard at a local hospital.
The plaintiff was arrested outside of a convenience store and transported to jail. He alleged he was assaulted by several law enforcement officers in the process. He was then transported to the hospital by ambulance where he alleged the law firm’s client used excessive force and conspired with other officers to violate his constitutional rights. From there he was taken to jail where he claimed he was a victim of excessive force by another officer.
Following an evidentiary hearing regarding the admissibility and reliability of closed circuit surveillance video, the federal court granted summary judgment in favor of the law firm’s client. Timothy Frets was the lead attorney in the case and was assisted by John Witten and Mary O’Connell. The case went to trial in April against the remaining defendants, who the firm did not represent, resulting in a jury verdict for the remaining defendants. Among other practice areas, Timothy Frets.
