Rouse Frets White Goss Gentile Rhodes litigation team wins Clay County defense verdict

Leawood, Kan. – September 27, 2019 –Rouse Frets White Goss Gentile Rhodes litigation team obtained a defense verdict in an eight-day medical malpractice trial in Clay County, Missouri.

The case, Piatt v. Rosbrugh et al., was a wrongful death action that arose out of a January 11, 2015, pregnancy labor and delivery at a local hospital. The child was transported to a hospital and died eleven days later on January 22.  Rouse Frets White Goss Gentile Rhodes’s attorneys Timothy Frets and John Witten represented the delivery nurse at trial. The OB/GYN physician and his employer also were named in the lawsuit and represented by a separate firm.

The plaintiffs alleged the nurse was negligent. The total amount sought was over $5 million. The trial began on August 19 and the verdict was rendered on August 28 in favor of all defendants.
