Brett Randol, Rouse Frets White Goss Attorney, Wins Summary Judgment for Client Facing Business Ownership Dispute

Leawood, Kan. – April 23, 2025: Brett Randol, an attorney with Rouse Frets White Goss Gentile Rhodes, P.C., recently prevailed in and out of court on behalf of a client whose business partners attempted to remove him from membership in a limited liability company formed for acquiring and developing real estate. Brett filed a lawsuit on the client’s behalf challenging the company’s ability to remove him, the membership interest valuation provisions of the company operating agreement, and various capital calls issued by the majority.

The case was partially settled at mediation. The client was paid substantially more for his membership interest than he would have received in the company’s initial attempt to remove him as a member, and was released from the challenged capital calls issued by the majority members. The Johnson County District Court then granted summary judgment in favor of Brett’s client on the remaining issue, entitling the client to receive additional compensation.
