Leawood, Kan. – July 24, 2025: Tim Frets, Mary O’Connell, and John Witten, attorneys with Rouse Frets White Goss Gentile Rhodes, P.C., recently obtained a judgment of dismissal with prejudice on behalf of a hospital in a multi-million dollar putative class action lawsuit involving the hospital’s website.
In its judgment, the trial court ruled that the claims against the hospital were barred by the doctrine of sovereign immunity. That judgment, which was subsequently designated final for purposes of appeal, is now the subject of a pending interlocutory appeal in the Missouri Court of Appeals.

Choice of an attorney is an important decision and should not be based solely upon a website or advertisements. In reviewing achievements by the law firm or its attorneys, remember that past results afford no guarantee of future results; each matter is different and must be judged on its own merits. Although our lawyers may practice in subject areas, neither the Supreme Court of Missouri nor The Missouri Bar reviews or approves certifying organizations or specialty designations for Missouri licensed attorneys.
