Randy Rhodes with Rouse Frets White Goss Gentile Rhodes obtains one of the largest personal injury judgments in Kansas

Rouse Frets White Goss Gentile Rhodes attorney Randy Rhodes, along with co-counsel Steve Sanders, recently obtained one of the largest personal injury judgments in Kansas in recent years.

In A.B. vs. the Estate of Elizabeth Bertels, the plaintiff, a minor, was traveling with Elizabeth Bertels, who was driving north on US Highway 59 in Atchison County, Kansas. Denver Barr was driving south on US Highway 59 when he crossed the centerline and entered into Ms. Bertels’ lane of travel. Ms. Bertels failed to notice Mr. Barr’s Jeep in time and failed to take evasive action to avoid colliding. After the wreck, Ms. Bertels passed away and the plaintiff suffered a serious, paralyzing injury.

The plaintiff sued the Estate of Elizabeth Bertels due to failure to exercise reasonable and prudent care while operating a vehicle. With the representation of Randy Rhodes and Steve Sanders, A.B. proved negligence against both Denver Barr and Elizabeth Bertels. The District Court of Johnson County, Kansas found the Estate of Elizabeth Bertels at fault, along with Denver Barr (60% from the Estate of Elizabeth Bertels and 40% from Denver Barr).

Total damages awarded were $15,758,245.

This is one of the largest judgment in Kansas in 2018.  Randy Rhodes was lead trial counsel in cases that resulted in two of the top three verdicts for individual plaintiffs in Missouri in 2017.
