Leawood, Kan. – July 21, 2025: Randall L. Rhodes, a litigation attorney with Rouse Frets White Goss Gentile Rhodes, P.C., recently secured a substantive legal victory in a Delaware bankruptcy court that illustrates his and the law firm’s leadership in bad faith insurance and complex commercial litigation matters.
The matter involves a firm client who was sexually abused by his Boy Scouts of America scoutmaster. Previously, Randy and the law firm successfully filed suit against the abuser on behalf of the client, to whom the court awarded $20 million in compensatory damages and $100 million in punitive damages. The court also made a finding of fact that the Boy Scouts’ insurance carriers acted in bad faith in not defending or indemnifying the abuser.
Next, Randy and the firm filed a bad faith collection lawsuit in Missouri seeking to garnish one or more of the Boy Scouts’ insurance policies from a several year time period during which the firm’s client was sexually abused. With post-judgment interest and fees, Randy and the firm are seeking to recover well over $200 million.
Recently, a Delaware bankruptcy judge found in favor of the firm’s client after a Boy Scouts bankruptcy trustee asked the bankruptcy court to order the Missouri bad faith case to be dismissed. The case was appealed to the district court, which affirmed the bankruptcy court’s order adopting the legal position advocated by Rouse Frets White Goss. Because of the experience and leadership of Randy and the law firm in this matter, the bad faith collection case can continue. An appeal has been filed in the Third Circuit Court of Appeals by the bankruptcy trustee.
