Journal of the Missouri Bar Publishes Attorney Ty Kalleck’s Article Calling for Legislature to Clarify the Business Premises Safety Act

Kansas City, Mo. – February 12, 2026: Ty Kalleck, an attorney with Rouse Frets White Goss Gentile Rhodes, P.C., was recently published in the Journal of the Missouri Bar. Ty’s article, “The Business Premises Safety Act needs clarification,” aims to reach the Missouri General Assembly in hopes that it clarifies certain language in the Act. 

Specifically, Ty writes that the Act provides no duty to protect third parties from criminal acts unless the business knows or has reason to know that such acts are reasonably likely to be committed in a “particular area” of the premises. He also writes the Act contains a confusing, and arguably contradicting, definition of “business.” These portions of the Act, Ty argues, present a potentially significant impact that, without clarification, may unfold only through costly litigation for both individuals and businesses across Missouri.
